Terms of Use

Welcome to Artiny, an app for coloring pixel-arts by numbers developed by Eduard Khachatrian ("Developer", "we", "us", "our"). These Terms of Use ("Terms") govern your use of the Artiny app ("App"), including all content and functionalities provided through the App.

Acceptance of Terms

By accessing or using the App, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any part of the Terms, you are prohibited from using the App.

App Use License

Subject to your compliance with these Terms, the Developer grants you a personal, non-exclusive, non-transferable, limited license to download, install, and use the App on your Apple device for personal, non-commercial use.

Coloring Page Use

You are permitted to use the coloring pages within the App for personal, non-commercial purposes only. The following are strictly prohibited:

• Reproducing and distributing any coloring pages outside the App without prior written consent from the Developer.
• Using the coloring pages for any commercial purpose unless such activities are expressly authorized by the Developer.
• Modifying, adapting, or creating derivative works from the coloring pages without prior written permission from the Developer.

These restrictions are in place to protect the copyright and intellectual property rights of the coloring pages provided in the App. By using the App, you agree to respect the intellectual property rights of the Developer and any third parties whose content may appear in the App.

User Contributions

The App allows users to upload their own pixelated images ("User Content") to be used as coloring pages by other users. By submitting User Content, you grant the Developer a perpetual, irrevocable, non-exclusive, royalty-free, worldwide license to use, publicly display, and publicly perform your User Content.

Representations and Warranties

You represent and warrant that:

• You own the User Content or have the necessary licenses, rights, consents, and permissions to authorize us to use the User Content as specified in these Terms.
• The User Content does not infringe any third party's rights, including but not limited to copyright, intellectual property rights, and privacy rights.

Copyright Complaints

If you believe that any content on the App infringes upon your copyright, or otherwise violates intellectual property rights, please contact us immediately at support@artiny.app. We take intellectual property rights very seriously and are committed to promptly addressing your concerns.

Subscription Services

The App offers a "Premium Subscription" that unlocks all features within the App. A detailed list of features included in the Premium Subscription can be found within the App itself. We reserve the right to modify, add, or remove features from the Premium Subscription at any time without prior notice. This allows us to continually improve the subscription and tailor our offerings to better meet user needs.

Payments for the Premium Subscription are processed by Apple through in-app purchases. The Developer does not handle payment processing and is not responsible for any issues related to payments.

Restrictions

You agree not to use the App in a manner that:

• Violates any national, international law, or local regulations;
• Attempts to reverse engineer, decompile, disassemble, or derive the source code of the App;
• Interferes with the proper working of the App, including the introduction of viruses, trojans, or other harmful materials.

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
